Administrative fine for nuisance

General

Submit an objection if you do not agree with a fine given for nuisance in a public area. You must submit the appeal within 6 weeks from the date (date of issue) of the fine.

What can you object to?

Fines issued for situations in public spaces concern:

  • Letting a dog run loose where it is not allowed.
  • Improperly disposing of rubbish.
  • Urinating in public.

For these forms of public nuisance, you can receive an administrative fine. If you disagree with the fine, you can submit an objection here.

Good to know

If you submit an objection, you do not need to pay the fine immediately. You will receive an acknowledgment of receipt by post within a maximum of 2 weeks. You will be granted a payment extension once you have received this written acknowledgment of your objection. If your objection is rejected, you must pay the fine within 2 weeks after receiving the decision.

Submitting an objection by Post

You can also send your objection by post. Your objection letter must include the following:

  • Your name, address, phone number, and email address
  • Reference number of the fine (this number is on the fine notice)
  • A copy of the fine you are objecting to
  • Reason for your objection
  • Date of your objection letter
  • Your signature

If someone else is submitting an objection on your behalf, include a power of attorney with the phone number and/or email address of the person authorized to act for you.

Submit an objection

After submitting your appeal, you will receive an acknowledgment by email or post (you can choose this when applying) with an explanation of the appeal procedure. The letter will explain the options you have to be heard. A municipal officer will then contact you by phone. You can then indicate your preference on whether and how you wish to be heard.

Invitation to a Hearing

If you choose to be heard, you will be invited to a hearing with a legal officer. During this hearing (official hearing), you will be asked additional questions and given the opportunity to further explain your appeal.

Decision on Your Appeal

The Board of Mayor and Aldermen will make a decision on your appeal. This decision is usually made within 6 weeks after the period for submitting the appeal has expired. The municipality can extend this period once by a maximum of 6 weeks. You will be notified if this happens.

Filing an Appeal

If you disagree with the decision on your objection, you can submit an appeal to the Zeeland-West-Brabant District Court within 6 weeks of the decision on your objection. There are costs associated with this.
