Statement on the processing of personal data when enforcing the low-emission zone

The council collects and uses different types of personal data from its residents and visitors. Which personal data are processed and for what purpose depends on the specific processing. The privacy statement below provides more information about the processing of personal data for enforcement of the low-emission zone.

Purpose

The purpose of processing personal data for the enforcement of the low-emission zone in Breda, is to be able to fine drivers of trucks who do not hold an exemption for the low-emission zone.

Grounds

The council processes these personal data based on the performance of a general interest task (article 6, first section, under e of the GDPR), i.e. Enforcement of Breda's low-emission zone, dated 21 October 2021.

Categories of personal data

To this end, the council uses the following categories of personal data:

  • vehicle registration plate;
  • photo (vehicle);
  • date/time/location of the violation.

Recipients

As part of the enforcement of the low-emission zone, Breda Council exchanges personal data with the Central Judicial Collection Agency (CJIB). CJIB imposes the fine and sends it to the owner of the vehicle.

No onwards transmission, no profiling

The personal data are not processed outside the European Economic Area. As part of the low-emission zone enforcement, the council does not create profiles.

Decision-making

All photos are checked by Special Investigating Officers. They establish whether there has been a violation and whether the data will be sent to the CJIB.

Retention periods

The council saves personal data for as long as necessary to perform its duties, or as laid down in the Public Records Act (Archiefwet). This means that your personal data collected for low-emission zone enforcement are subject to the following retention periods:

  • Non-violations: Photographs and registration plates of trucks that do not violate the entry ban to the low-emission zone imposed in Breda, will be deleted from the camera and server as soon as possible and, in any case will not be saved for more than 72 hours after recording.
  • Violations (fines): 5 years. In accordance with the policy framework for digital enforcement of the Public Prosecution Service, Breda Council must save the digital recordings for a 5-year period.
  • Objections: 7 years in connection with audits, in accordance with the Public Records Act (Archiefwet) and the Selection List for records of municipal and inter-municipal bodies 2017.
